DESCRIPTION This study-unit was designed by Dr. John Consiglio, around the writings of authors of the likes of Edward J. Kane who, using the classic Hegelian dialectic model, analysed and propounded his reality theory of the constant re-regulation process in any modern economy, Joseph J. Norton, whose ideas about the basic essential building blocks of the new international financial architecture (these are amply supported in several important writings in IMF publications), Barth, Caprio and Levine’s almost fatalistic acceptance of eternal regulation “till angels govern”, and Charles Goodhart’s more recent and quick summing up of the post-crisis regulatory scenario.

Dr. Simon Grima, continued to develop the course and added a practical approach to Governance and Compliance. Adding areas such as compliance with Data Protection and Prevention of Money Laundering. These subjects are complimented with case studies taken from the real world and the lecturer's experience in the field.

The idea of the study-unit is to give students an understanding of the spirit behind having regulations and on how to approach certain issues. The course deals with the international law-inspired approach and basic considerations necessary for the ongoing reconstruction of the new international financial architecture. It also deals with early warning systems, and certain regulatory requirements. The course is also intended to serve as early basic groundwork for students eventually following Course BKF4081 Banking Regulation

Study-unit Aims:

The idea of this study-unit is to give students an understanding of the spirit behind having regulations. Learning Outcomes:

1. Knowledge & Understanding:
By the end of the study-unit the student will be able to:

- Comprehend the nature of the problems in regulating and making regulations;
- Understand why there is regulation;
- Appreciate:
    a) Why the need to Regulate?
    b) How to Regulate?
    c) What is important when Regulating?
    d) What are the objectives..where do we want to arrive?
    e) Will regulation help us reach these goals?
    f) How to deal with Data Protection and How to prevent Money Laudering.

2. Skills:
By the end of the study-unit the student will be able to:

- Develop the skills required to understand the regulation and why they are needed;
- Develop the skills to work as a regulator and in a compliance environment.
