DESCRIPTION The study-unit will delve into the evolution of climate law, at the International, EU and national level. It will explain how the Maltese initiative evolved, what are the legal implications of climate change as a common concern of humankind, how salient developments at that time influenced the negotiations leading to UNFCCC.

The study-unit will assess the provisions of both the UNFCCC and the Kyoto protocol, the Paris Agreement.

It will also examine Maltese and EU law implementing the obligations of both UNFCCC and the Kyoto protocol and the Paris Agreement.

Study-unit Aims:

- To acquaint the student with the applicable legal regimes that address climate change;
- To identify the tools and methodology that may be applied in order to formulate climate change policy and law;
- To acquaint the student with the evolution of climate change law and policy;
- To identify an adequate legal framework that applies for mitigation measures to climate change;
- To acquaint the student with the possible options and strategies that may regulate adaptation measures to climate change.

Learning Outcomes:

By the end of the study-unit the student will able to:
(a) Understand how climate law has evolved to address climate change and to what extent has this process influenced international principles in general;
(b) Understand the legally binding commitments relating to climate change from an international, EU and national perspective.

Skills:

By the end of the study-unit the student will able to formulate policy and legislation to regulate climate change negotiates within decision making bodies/amongst stakeholders applicable rules and policy instruments.
