TITLE Social Law and Practical Issues of Industrial Law

DESCRIPTION The study-unit is divided into two parts and intends to (i) introduce students to social legislation, and (ii) to expose students to practical legal issues relating to industrial law.

In the first part students shall examine the main provisions of the law pertaining to social security, the welfare state, health services, education and housing and shall expand on the main provisions of each legislation examined.

In the subsequent part, students shall evaluate specific legal issues of: equal opportunities, social dialogue, collective bargaining and collective agreements, minimum employment conditions, subsidiary legislation under the Employment and Industrial Relations Act, and case studies of the Industrial Tribunal.

Study-unit Aims:

The aim of the study-unit is to expose law students to the main and most important social legislation in Malta particularly legislation on which the welfare state is based and other legislation deriving from social policy considerations.

Furthermore the study-unit aims to address practical legal issues pertaining to Industrial Law in Malta.

Ultimately the study-unit aims to also ensure that the interrelation of all social legislation is duly considered.

Learning Outcomes:

1. Knowledge & Understanding
By the end of the study-unit the student will be able to:

- Appreciate the importance of social legislation;
- Understand the objectives of such social legislation and its application in sustaining a welfare state;
- Understand the link between several social legislative acts;
- Demonstrate an in-depth knowledge of employment and industrial relations legislation.

2. Skills
By the end of the study-unit the student will be able to:

- Guide himself and others with regards to main legislation related to the social policy sphere;
- Keep up to date with the evolving social legislation and deriving main benefits and entitlements due to citizens;
- Apply employment and industrial relations legislation in practical situations as a practitioner;
- Critically examine practical situations in employment and industrial relations.
