DESCRIPTION This study-unit offers a study of the various grounds of marriage nullity found in the Code of Canon Law: their treatment in canonical doctrine and studies and most of all in contemporary canonical Jurisprudence.

Study-unit Aims:

-- examines the role of jurisprudence as a source of law

-- gives a detailed analysis of the various grounds of nullity as interpreted and applied by Church tribunals, especially by the Tribunal of the Roman Rota.

Learning Outcomes:

1. Knowledge & Understanding:
By the end of the study-unit the student will be able to:

-- Understand and distinguish between the various grounds of nullity

-- Know the various doctrinal sources at the origins of such grounds

-- Appreciate the nature and importance of jurisprudence in forensic praxis

2. Skills (including transferable [generic] skills):
By the end of the study-unit the student will be able to:

-- apply in a practical way what has been learned so far

-- Individuate the possible cause/s of nullity in concrete situations

-- Interpret and formulate one’s own arguments in favour of one’s opinion based on doctrinal and jurisprudential sources
