DESCRIPTION This study-unit aims to acquaint the students with the general principles of law, with the various fields of law and in particular to introduce students to those areas of Maltese law, comprising (a) an introduction to constitutional law. This includes a general overview of the Constitution of Malta to include the various organs of Government, the Legislature, Executive and Judiciary. The structure of Cabinet Government is also reviewed together with the various important public commissions. Particular focus is placed on the law of human rights and fundamental freedoms, with reference to the European Convention on Human Rights and Fundamental Freedoms and the workings of the European Court of Human Rights in Strasbourg b) an outline of the organisation of the Maltese Courts and the procedure to be followed in any action taken before them. This refers to the jurisdiction and competencies of both the criminal Courts at first instance and at the appeal stage and also the Civil Courts. Students are taken through the general notions and distinctions between the criminal and the civil proceedings; and (c) elements of Competition Law. An introduction to this important topic includes the general legal notions related to competition law and the prohibition on practices which tend to prevent or distort competition or amount to an abuse of a dominant position. Students are taken through the competition act, and the relative regulations on concentrations in mergers and acquisitions. Reference is also made to the regulations of the European Union and the judgements on the matter of the Luxembourg European Court of Justice.

Study-unit Aims:

The study-unit aims to extend to students general basic legal knowledge which is required to understand the legal framework of their future duties as business professionals in the areas of constitutional law, Maltese court organisation and competition law.

Learning Outcomes:

1. Knowledge & Understanding:

By the end of the study-unit the student will be able to evaluate and follow a discussion on these topics. They will have acquired a general basic understanding on the subject which will enable them to contribute on general lines in any similar evaluation.

2. Skills:

By the end of the study-unit the student will be able to progress in critical thinking and analysis, with their practical applications.
