      <title>The role of tradition in the Maltese mixed jurisdiction</title>

      <description>Title: The role of tradition in the Maltese mixed jurisdiction
Authors: Ando, Biagio
Abstract: The aim of this paper is to provide significant insights into the Maltese&#xD;
legal system with a special focus on private law. The assumption is that&#xD;
this legal system is the by-product of the "mixing" of innovation and&#xD;
tradition, resulting from the interaction of common law and continental&#xD;
law. A major role in the development of the system is played by the&#xD;
courts. Some examples (moral damages and pre-contractual liability) are&#xD;
considered which highlight the importance of the creative role adopted&#xD;
by the Maltese judges.</description>

      <title>Social and economic rights in the Constitution of the United States</title>

      <description>Title: Social and economic rights in the Constitution of the United States

Abstract: The article starts by discussing the most common explanations for a substantial&#xD;
silence of the US constitutional culture on social and economic&#xD;
rights. It then suggests that the most plausible explanation seems to rest&#xD;
rather than on what it is usually referred to as the American exceptionalism,&#xD;
on a peculiar culture of rights spread among US legal thinkers and&#xD;
endorsed by Supreme Court Justices. A review of the past and more recent&#xD;
Supreme Court case law on social and economic rights is presented,&#xD;
as well as a tepid prediction of what will occur in the future.</description>
