Authors: Marano, Pierpaolo
Abstract: Il saggio esamina l’impatto dell’AI Act (Reg. (EU) 2024/1689) on the European framework for Product Oversight and Governance (POG) and insurance distribution, with particular emphasis on its interaction with the IDD Directive, Delegated Regulation 2017/2358, and the corresponding EIOPA Guidelines. It analyses the use of high-risk artificial intelligence systems throughout the insurance product lifecycle—from design to distribution and post-sale monitoring—highlighting how this affects the compliance function, disclosure obligations, algorithmic transparency, and the liability of market participants. The paper concludes by proposing an integrated compliance approach that aligns the AI Act, the GDPR, and sectoral regulation, with the aim of protecting policyholders and ensuring regulatory sustainability.
