Abstract: Introduction: This paper analyses the extent to which Malta has made good use of its European Union (EU) membership within the Maltese Broadcasting landscape and Malta’s contribution in this sector. It asks: did Malta benefit from the EU Media Programme? If yes, to what extent? If no, why were opportunities lost? What approach should be adopted for the future to reap such benefits? Moreover, this paper will discuss whether Malta did transpose with or without difficulties the EU Television Without Frontiers (TWF) Directive; whether Malta has, since attaining membership, participated actively or passively in the discussions on the amendments to the TWF Directive culminating in the 2007 Audiovisual Media Services (AVMS) Directive; whether Malta has safeguarded its interests during these discussions and whether it has participated in any lobby group which it felt was propagating its interests. It also discusses what measures have been taken by Malta to transpose the AVMS Directive and whether Malta is still on time to transpose it by the due date (December 2009). Has Malta carried out any consultation process on the Directive’s optional provisions? Have the new Directive’s provisions been explained to stakeholders and how will Malta cushion any adverse effects thereof, if any? [Excerpt]
