Abstract: The main national legal instrument introduced to implement Regulation (EU) 2016/679 (General Data Protection Regulation, hereinafter “GDPR”) in Malta is the Data Protection Act 2018 (hereinafter “DPA”), which repealed and replaced the Data Protection Act of 2001 which was the legislation that transposed Directive 95/46/EC. Subsidiary legislation has also been passed under the main Act, for example the Data Protection (Processing of Personal Data by Competent Authorities for the Purposes of the Prevention, Investigation, Detection or Prosecution of Criminal Offences or the Execution of Criminal Penalties) Regulations, transposing Directive (EU) 2016/680.
