Abstract: This thesis examines the new founded link between corporate governance and human rights. The relationship is first examined in the light of the increasing relevance of human rights to companies which, as the author argues, is a result of the ever growing power and authority that the modern day company enjoys. As a consequence, nowadays certain large companies are being considered to have just as much, if not more, influence on human rights than States do. The warning sounded to companies in this thesis is that, as a result of this expanding corporate clout, companies can no longer ignore human rights since doing so or even violating human rights could result in reputational or possibly financial harm for the company. Added to this, the study shows how companies are being increasingly expected to respect human rights in a number of hard law and soft law instruments, with the most influential being the UN Guiding Principles. The objective of the thesis is reached by proving that a contemporary understanding of corporate governance does in fact entail respect for human rights, as best reflected by the fact that the Charter of Fundamental Human Rights includes for the first time the right to good administration. The author furthermore argues that the challenge now is to apply good governance to also include respect for human rights. However, after analysing the situation the conclusion reached is that there is still a long way to go for businesses abroad and in Malta alike to associate the two together.
