Abstract: | Through this Thesis a legal source into various legal aspects of culture is created whilst taking a look into the different methods of protection. Language, education, access and participation, heritage and food are all different cultural vices, which this Thesis discusses. Each are discussed with a legal perspective that brings outs the lack of development and recognition. The development of culture depends tremendously on State interaction however depends on the individual or community to participate and access culture. Culture is not specifically defined and never will be which is why it is such a complex matter. Culture represents various historical, cultural, traditional and intellectual developments and this thesis tries to recognise these intrinsic values. Culture is an essential part of human constantly reinvented and transmitted from generation to generation, providing individuals and communities with an identity; offering others the opportunity to access and participate in foreign cultures as well as their own. It is this process, which requires further development and recognition and this Thesis highlights the breakthroughs as well as the short falls through a legal assessment. |
