Abstract: Travel and tourism have always been important aspects of social life but it is even more true today to say that they have assumed such large proportions that the need has long been felt in many countries, amongst them Malta, to prepare and enact legislation dealing with the various legal aspects that these two human activities have brought in their wake. The greater the facilities to travel have become, the more numerous are the problems relating to the hotel industry and the more international they have become. Although it is true that most countries have had some provisions in their Civil Code or their Code of Obligations to regulate these problems, yet it is today evident that the rules regulating such problems are now completely independent of the provisions of the Civil Code.
