Abstract: Legal issues relating to children are always difficult to tackle because they relate to a particular sector of society which requires special considerations. The rights of the children have essentially emerged in the twentieth century. Since then society in general has dedicated particular attention to safeguard the needs and well-being of children. Such issues become even more complex when one deals with concepts relating to the commercial sexual exploitation of children. The term 'commercial sexual exploitation' in itself denotes a form of violation to the human dignity and when such violations relate to children, the problem becomes even more appalling. The thesis aims at presenting a legal narrative analysis of legislative initiatives which have stimulated major child-oriented measures in the field of child pornography and child prostitution. Thus, my main concern throughout the thesis will be to discuss the development of legislative instruments. The thesis will be divided into two main Sections, that is, Section A dealing with Child Pornography and Section B dealing with Child Prostitution. The thesis starts with an introduction that explains the aim, method and sources analyzed throughout the thesis. Thus, this part will explain in a nutshell the structure of the thesis. Thus, Section A dealing with Child Pornography will follow. The first chapter of this section will deal with a historical perspective whilst the second chapter deals with some important definitional queries. Moreover, the third chapter examines the role of Internet and computer technology as regards child pornography. Chapter four is entirely dedicated to international legislative instruments dealing with the subject whilst chapter five relates to foreign legislations, namely UK and Italian laws. The last chapter is dedicated to the Maltese law. This chapter includes a comparison between our legal systems and the above-mentioned legal instruments as well as some important recommendations which may enhance our law on child pornography. The second section, that is, Section B deals with Child Prostitution. The structure of this section is similar to the previous. Thus, the first chapter deals with a historical perspective relating to the subject whilst the second chapter is dedicated to some important definitions. Chapter three examines the legal position at international level, whereby reference is made to some important international instruments. The fourth chapter deals with foreign legislative systems, namely, the UK and Italian legal instruments. Chapter five provides a legal analysis of the Maltese legislative framework. This chapter will compare and contrast our legislative system with the above-mentioned legal instruments and reference is made also to some important recommendations which may enhance our legal position on child prostitution. The last part of the thesis is dedicated to the Conclusion. This part summarizes the main points that are discussed throughout the thesis. Furthermore, in this part of the thesis I intend to draw some conclusions which are of benefit to combat these forms of commercial sexual exploitation against children and to safeguard the best interest of every child.
