Abstract: Digital technologies are bringing about major changes in the audiovisual sector. In particular, digital technology is leading to convergence of networks, services, and markets. Such developments will very likely require the adaptation of both the regulatory framework and the various support mechanisms. Regulatory policy in the audiovisual sector is aimed at safeguarding certain public interests, such as cultural and linguistic diversity, the protection of minors and consumer protection. These are not called into the question by the technological developments. In fact, there seems to be a wide consensus, even at E.U level, that separate approaches to the regulation of transmission infrastructure and content should be adopted: services providing audiovisual content should be regulated according to their nature and not according to their means of delivery. However, new regulatory approaches and techniques would appear necessary for the future. This thesis studies the current regulatory framework for broadcasting in Malta, specifically the institutional characteristics of the Malta Broadcasting Authority and the Malta Communications Authority. In addition, it analyses the effect of convergence at European Union level, taking as a case study OFCOM in the U.K. In relation to regulatory structures, different forms, types and alternatives are examined in the light of proposing workable options to be applied in Malta.
