The environmental liability directive : an appraisal

Abstract

This thesis is concerned with an examination of Directive 2004/35/CE of the European Parliament and of the Council on environmental liability with regard to the prevention and remedying of environmental damage. Chapter One analyses the various stages of development which took place prior to the entry into force of the EU Environmental Liability Directive. It examines the Green Paper, the White Paper and other Commission's Proposals along with the position taken by various EU institutions, up until the final adoption of the above-mentioned Directive. Chapter Two delves into the actual contents of the EU Environmental Liability Directive. It tackles the various provisions and examines their implications and effects in the context of environmental liability. Chapter Three is concerned with an examination of the critical approach taken by several Non-Governmental Organisations and other Environmental Organisations with respect to the provisions laid down in the EU Environmental Liability Directive. Chapter Four is yet another important chapter as it studies the relationship between the EU Environmental Liability and other International Conventions. Finally, Chapter Five concludes this work by looking into the future of this directive and examines what could be the overall result and effect of the implementation of the EU Environmental Liability Directive.
