The law & practice of social work in child care

Abstract

This thesis starts on the premise that children have the right to express their ideas and feelings, just as much as adults. However, for many children, communicating with the adult world is not straightforward. Therefore, whether in supporting families, or in protecting children or in providing substitute care or work for young off enders, this thesis shows that social work activity constitutes an important link for children with the adult world. The way in which social practitioners work with or on behalf of children is becoming increasingly informed by a framework of law. This thesis sets out the practice of social work law in childcare. Clear and detailed guidance by the law help social workers to apply complex decisions to factual situations. It is important for social workers to be clear about what is a model for good practice in relation to their work with children. Such practice is explored in two selected areas of childcare: Child Abuse and Juvenile delinquency. The legal and practical problems of protecting children from violence and preventing children from being the perpetrators of violence are considered in detail and suggestions are offered. It is argued that social workers have duties toward children which need to be assessed and defined. The conclusion serves to identify what changes will be necessary if social work as a profession is to further develop its work with children.
