dc.description.abstractThis thesis attempts to give a detailed picture of the Mediterranean Action Plan's legal framework which consists of the Convention for the Protection of the Marine Environment and the Coastal Region of the Mediterranean and its six Protocols, also known as the Barcelona System. The subject is first introduced by emphasising the particularity of the Mediterranean as a semi-enclosed sea, and by giving a roadmap of the most important achievements in marine environmental protection, starting from the Stockholm United Nations Conference on the Human Environment of 1972, the Regional Seas Programme born in 1975 under the auspices of the United Nations Environment Programme, and the development of the concept of sustainable development at the United Nations Conference on Environment and Development, held in Rio de Janeiro in 1992. In Chapter 1, the writer gives a brief overview of the United Nations Environment Programme with special attention given to the Regional Seas Programme and particularly, the Mediterranean Action Plan and its various components. Chapter 2 enters into the analysis of the legal provisions of the amended Convention and its six protocols, whilst Chapter 3 discusses the Convention within the European Union legal order and the various EU marine policies, some of which are very recent. These include the Euro-Mediterranean Partnership and the European Neighbourhood Policy, and the proposed Green Paper for a future maritime policy for the EU. Chapter 4 briefly analyses Maltese law with regards to the protection of the marine and coastal environment by giving examples of the growing complex body of legislation and policies protecting the marine environment. The last part of this thesis in Chapter 5 focuses on the compliance, implementation and enforcement of the Barcelona Convention. The greatest weakness of the Barcelona System's implementation lies in the fact that not enough states have ratified some of its most important Protocols and it does not yet have concrete means to ensure that Contracting Parties are transposing the scope of the Convention and its Protocols into their domestic law. Finally, the main points of the thesis are summarised in the conclusion.en_GB
