Abstract: The first title of Book First of our Civil Code reads "Of the rights and duties arising from marriage". This presupposes the existence of a union between husband and wife which confers rights and imposes duties which are regulated by the Code. The Code is concerned with the effects of the contract of marriage and not with the contract itself. It is perhaps unique among all modern codes of law in looking any rules purporting to regulate the institute of marriage, its constitution, requisites and formalities.
