Abstract: In this thesis I go into the medical and legal aspects of abortion, analysing the impact one sphere has on the other. The aim of my work is not to arrive at a definite conclusion but to trace the links between the various theories and their influences in the area. I have gone into the different theories about whether the fetus has got a status of its own or not. Then I have gone on to discuss the mother's right to abortion vis a vis the right of the fetus to live, if such right exists after all. In the fourth chapter I have discussed the US case ROE v WADE, which is a landmark in the abortion issue. Other cases have been quoted, which have either sustained what the Supreme Court declared in 1973, or which have gone outright against that judgement. In the fifth chapter, I tackle abortion in relation to homicide and try to elicit the differences and the similarities between the two. Finally in the last chapter, I compare various laws from different countries which have varying traditions and social policies, with the present Maltese situation. This study has led me to conclude that abortion is a still highly debatable issue, about which no consensus has been reached up to the present day.
