Jurisdiction and competence of local tribunals and commissioners for justice and the local enforcement system

Abstract

This thesis revolves around the functioning of the Local Enforcement System (LES). It incorporates the study of the prime areas of interest within the LES and defines the entire process with references to the law establishing them. As a background to the subject, the thesis starts off by presenting a chapter dedicated to defining the theories of Jurisdiction and Competence, since the existence of the LES is entirely dependant on delegated offences which previously were within the jurisdiction of the Court of Magistrates. The core of this thesis deals with all the various segments that make up the LES as a whole. This exercise involved an in depth analysis of Chapter 291 - the Commissioners for Justice Act; which study located, identified and produced a comprehensive list of the delegated offences. The thesis also presents detailed chapters on each of the following: Citation, Notification and Summons; Enforcement; Fines and Penalties; Prescription; Appeals, Retrial and Petitions Board.
