Abstract: The effective protection of the right to a fair trial gives rise to a global challenge. Put simply, every person has the right to a fair trial both in civil and in criminal cases. Yet a glance at the jurisprudence of the international monitoring organs makes it clear that the right to a fair trial is frequently violated in all parts of the world. The vast majority of cases dealt with by the European Court of Human Rights (hereinafter "the Court") under the European Convention on Human Rights (thereafter "the Convention) concern alleged violations of pre-trial or trial rights. With this regards, the Convention has had and will continue to have a profound influence on the concept of a fair trial both among those States which adhere to it and those which wish to cooperate with Convention States in the administration of justice, and primarily criminal justice.
