Abstract: The progress achieved by the human rights movement is not appreciated enough unless a comparison is made between the present and the past. The Maltese legal system provides an example of how the respect for the individual’s fundamental rights gained prominence and now stands on an equal footing with the need to protect the interests of the collectivity. The forms of punishment incorporated within a legal system are dependent on the politicla, social and philosophical concepts prevailing within a particular society, at a paricular stage of its evolution. Legislators, sensitive to public opinion, strive to find the delicate blaance between the necessity of providing means of social control, and at the same time guaranteeing the citizen’s fundamental human rights. On the other hand, it would be contrary to the needs of the state if breaches of the law are dealt with lightly. Thus those who have to judge and who will ultimately determine what punishment is to be inflicted, are protected from the pressure that could be exerted by politicians. It is important to provide more information on the offender and to forward such data to the Courts. Legal punishments are remedies to legal and social problems but they are not to be considered as the only means of ensuring the observance of the law. Parental authority and the influence of teachers should contribute to instil a need to respect authority in all its multiple forms.
