Abstract: The European Union is actualising a policy aimed at externalising its border control and migration management policy towards Maghreb countries, by financing through its development programmes the enforcement of these countries' counter-migration facilities. This article studies the enactment of this policy towards Libya. It will be demonstrated that the human rights record of this country is very poor. It will be shown that the European Union and its Member States risk breaching their international obligations in the domain of human rights by enacting this policy, without introducing strong and enforceable human rights conditionalities.
