| DESCRIPTION | Entertainment Law is a field of legal practice that applies to business settings commonly encountered in the entertainment industry. The study-unit therefore sets out to examine the legal and business rudiments of the entertainment industry through analysis of practical scenarios presented to participants such as journalists, audiovisual content creators, and public relations personnel. The introductory part of the study-unit will provide an overview of the different legal organisations available under Maltese law, with particular emphasis on companies and partnerships. The second part of the study-unit will examine the various legal mechanisms available to artists, content writers and creators who wish to protect their intellectual property. This includes insights in respect of the procedures, costs and avenues for enforcement of intellectual property rights. Sample agreements concerning the protection of intellectual property rights will also be examined to provide an understanding of what makes a contract valid and enforceable and key operative clauses. The final part of the study-unit will outline different methods of raising capital to finance a project and includes an examination of sample loan agreements in order to highly key operative clauses that prospective borrowers should look out for. An overview of non-traditional methods of raising capital will also be given during this part of the study-unit. The objective of this course is to equip aspiring participants of the entertainment industry that do come from a legal background with basic legal skills that are useful to effectively plan projects, negotiate agreements and structure transactions from an informed position. |
