| DESCRIPTION | This study-unit will explore the Immigration Act (Chapter 217 of the Laws of Malta) in detail in order for students to become intimately familiar with this law since it is the main chapter of the Laws of Malta which deals with immigration into Malta. The study-unit will also explore the functions of the administrative entities mentioned in the law, particularly the Department for Citizenship and Expatriate Affairs and the Principal Immigration Officer. The Return Directive will also be dealt with in detail. The policy aspect of this study-unit will introduce the students to the effects of different policies from migrants’ perspective. Study-Unit Aims: - Familiarise students with the Immigration Act and subsidiary legislation enacted thereunder; - Acquaint students with the Return Directive; - Familiarise students with the administrative process of obtaining visas and other permits as well as with the appeal process before the Immigration Appeals Board; - Familiarise students with the relevant policy issues. Learning Outcomes: 1. Knowledge & Understanding By the end of the study-unit the student will be able to: - Comprehend the Immigration Act and other legislation related to migration which will be dealt with during the course; - Comprehend the Return Directive; - Evaluate the local administrative process of obtaining visas and other permits as well as the appeal process before the Immigration Appeals Board. 2. Skills By the end of the study-unit the student will be able to: - Apply the provisions of the Immigration Act to given situations; - Demonstrate appropriate use of the applicable laws to represent a third-country national client before a competent court or tribunal; - Take the policy issues into account when making submissions before courts and tribunals.
