DESCRIPTION Objective

This study-unit aims to give students a basic grounding in some of the key fields of law relating to tourism. On one level, this means investigating the rights and obligations of tourists vis-à-vis employees and other operators at various stages of the tourist experience. Various features of Maltese law that concern tourists and tourism operators will also be dealt with. It is also important to explore the legal structuring of the tourism sector itself, by exploring particular legal arrangements, such as time-share contracts and the legal regulation of the associated heritage and environmental sectors.

Course Content

The themes of the course will include:

- The legal system and the classification of law
- The various forms of business organisation
- The sources of obligations under civil law
- Contracts, quasi-contracts, torts and quasi-torts
- Guarantees and documentary credits
- Employment and discrimination
- Food Safety
- The liability of the Hotel keeper
- The historical development of tourism regulation in Malta
- The main principles of Public law regulating the relationship between individuals and business organisation and Public Authorities in the context of tourism regulation
- The Malta Travel and Tourism Services Act
- The Malta Tourism Authority
- Enforcement powers of the Malta Tourism Authority
- Remedies against decisions of the Authority
- Package Travel
- The EU Council Directive on package travel, package holidays and package tours
- Denied boarding compensation in scheduled air transport
