Abstract: Construction is considered a very litigious industry and generates a significant amount of disputes. Disputes are costly and this has been a driver to resort to alternative methods to resolve them. Mediation has gained popularity because of the cost and time advantages over other dispute resolution methods. This dissertation reports a research study undertaken to explore the potential use and efficacy of mediation in construction-related disputes in Malta. Secondary Data Research was used to investigate how many of the cases ending up in court are related to construction; what types of disputes are the most frequent and finally whether there is a place for mediation in disputes related to construction in the local scene.
