Abstract: Since 2002, Malta has experienced a drastic increase in the number of irregular immigrants who have reached our shores. One of the main reasons for such a development may rightly be said to have been Malta’s accession to the European Union. As a matter of fact, Malta has thus contributed in pressing for the further control of irregular immigration and this in line with the fact that our island’s strategic geographical position makes it the southernmost border of the European Union. This has led to setting the area as a top priority one and eventually leading to recent major developments over the last few years. Recent issues such as the recent dispute between Malta and Italy over illegal immigrants trigger into play the existence of International Treaties dealing with such situations. Moreover, the situation and policy of detention centres directly hints at fundamental human rights issues. With this picture in mind, the thesis will propose a study of the various ways through which irregular immigration has been tackled by the European Union – thus pinpointing the major developments made in this field throughout the years. The thesis will be developed through a closer look at the immigration policy – its forming part as an integral part of the European Union’s Justice and Home Affairs. Furthermore the study will take into consideration the recent developments in this field and the various proposals which are currently in the pipeline.
