Abstract: Throughout the last two decades, one could notice that in various local newspapers, official reports and policies, the issue of a Children Act was raised various times by different persons, including amongst others professionals working in the child-law field, politicians and experts as well as students and academics through various dissertations. In addition to this, there have already been two drafts of a Children Act for Malta that have been drawn up, but which have not been taken further. Thus, it is clear that although the issue of whether Malta should have a Children Act or otherwise has not as yet been on top of the Maltese political agenda, it was never completely forgotten and from time to time persons who have this topic at heart have attempted to raise this matter again. All this provided ample motivation for this thesis to be compiled. First and foremost, a brief comparative appraisal is made in order to gain a general overview into the situation with regard to child legislation in foreign states such as the United Kingdom, Ireland, Italy and Belgium. Moreover, this thesis also delves into child-related legislation and what was held throughout these years in relation to the need or otherwise of a Children Act in Malta. Furthermore, experts' viewpoints were also taken and thus provided first hand experiences and opinions on the topic. In addition to the above, this thesis also illustrates that there is no clear cut answer to the question it poses, and thus, a two-fold recommendation, that might help and further improve the position of child-related legislation in Malta, is provided, with the much awaited introduction of a Children Act chosen to be as the optimal solution to the current problems.
