Title: The ‘corrective mechanism’ in the Maltese electoral law : a constitutional misnomer?

Abstract: The ‘Corrective Mechanism’ in the Maltese electoral law is a term applied by legal academics when referring to Act IV of 1987, Act XI of 1996 and Act XXI of 2007. The question this thesis attempts to answer is whether this name is still applicable to the corrections emanating from these amendments, especially after the introduction of the 2007 revisions. The analysis will evolve around these amendments and their effects by evaluating election results before and after their introduction. The research will analyse whether the introduction of any of the said amendments would be changing the Proportional Representation by the Single Transferable Vote (PRSTV) system applied in Malta and how this effects Cross Voting. Furthermore the research shall define and explore the problems caused by wasted votes and gerrymandering. The dissertation strives to illustrate as to why the term ‘Corrective Mechanism’ is today in fact a misnomer, and, how the amendments have instead created a new variation of the PRSTV. Following this analysis, the study will suggest proposals as to possible amendments to the Maltese electoral system to achieve the goals set by the Members of Parliament when discussing the implementation of the previous modifications. The suggested proposals concern the curbing of wasted votes, the method of choosing the President of the Republic, the introduction of further proportional corrections and the introduction of an electronic system in the counting process to eliminate human error. The goal of these suggestions is to have a president elected through consensus, thereby enabling him/her to select the Electoral Commission as Parliament consent puts the President in a more trusted position. The suggested amendments would guarantee better proportionality and governability.
