Abstract: The contract between Mr Strict and Clementine would be held to be valid and Clementine would not be able to challenge her father's action. Variation: The result would be the same. Maltese law, while not accepting the validity of contractual clauses which constitute a total restraint on marriage, permits clauses which constitute a partial restraint on marriage. One such example is the provisions that upholds the validity of legacies consisting of, for example, a right of habitation contingent on the legatee remaining a bachelor or spinster, or a widower or widow.
