Abstract: | The Maltese Legal System, published by the Malta University Press, has established itself as the leading work on Maltese Law. The lack of a series of comprehensive studies on Maltese Law has been very much felt over time, especially by law students. Professor David J. Attard's publication undoubtedly contributes to our legal literature and does so in such a way that makes it comprehensible also to persons with no legal expertise. The second volume of The Maltese Legal System is divided into two parts, with the first part focusing primarily on Constitutional Law. This Volume is an encyclopaedic work which represents the latest commentary on the fast evolving Constitutional Law of Malta, lately a subject of great public debate. I consider this monograph to be unique in many aspects. It takes into account an in-depth analysis of the Constitution and deals with the latest Maltese Constitutional controversies. It also combines well thought academic research with political constitutional realities. This book recognizes the contribution made by former Presidents, Prime Minister Dr Joseph Muscat and Former Prime Ministers. Its appendices shed valuable light ·on the study of Maltese Constitutional Law and are an indispensable source of legal literature which contributes to make the volume an all comprehensive study of Constitutional Law and an indispensable tool for legislators, law reformers, members of the judiciary, legal practitioners and law students. As Guardian of the Constitution, I feel impelled to render homage to all those who throughout the years foresaw the importance of establishing a sound legal system well-embedded in the Constitution. Their commitment and sheer enthusiasm should stir us all to resume with the building of solid structures that would enhance a more inclusive society based on the tenets of human rights and the rule of law. I intend to continue with the constitutional contributions of former predecessors in office and surely this work will provide fruitful guidance in that respect. The study propounds convincingly that the grund norm, upon which the authority of the Constitution ultimately depends, is the will of the people. This fundamental premise is masterly elaborated in this commentary. Any future constitutional developments will have to bear the author's conclusions on the grund norm in mind. It is therefore a pleasure for me to introduce this book to readers whom, I am sure, will find it to be a very interesting, erudite and an informative read. |
