Abstract: The European Union introduced a Regulation on advanced vehicle systems including the event data recorders. This Regulation identified the purposes and the way of using these tools, while delegated acts will supplement the Regulation by providing detailed rules on the specific test procedures and technical requirements of such systems and, therefore, of the event data recorders. This legal framework is not exhaustive however of the issues arising from the use of event data recorders. The paper will examine which legal issues have emerged in Italy, that is, the nation with the largest number of these devices in the world, which has anticipated the decision of the European legislator for several years.
