| Abstract: | The emergence of the Animal Rights Movement has sought to spread the belief that animals, just like humans, have rights which need to be protected at law. Despite the significant advancements in Animal Welfare legislation, both globally and locally, cases of animal abuse remain high. In order to address this, the need for research to analyse the legal situation and determine what element, if any, has led to inefficient legal systems in this regard was felt. This work investigates the topic of animal welfare within a variety of legal systems by carefully analysing the relevant Maltese; English; Turkish; and Kenyan legislation, and assessing them comparatively. Subsequently, a brief overview of the European Union's impact and influence – if any – on such legal systems will also be delved into. Following this analysis, this study then investigates whether the respective courts of the above-mentioned states have adequately or otherwise implemented their respective laws. The conclusion of this study brings this research paper to life by highlighting concerning provisions within each legal system analysed, which require a legal rethink in order to ensure adequate animal welfare protection. |
