| Abstract: | Mergers by acquisition are one of the tools companies may utilise to join forces and become stronger. Sometimes, mergers by acquisition can even provide protection for companies that might not survive in other circumstances. This dissertation gives an overview of mergers by acquisition from a theoretical perspective and a practical side. Such analysis is carried out not only from the Maltese perspective, but also from the UK and Indian perspective. Maltese law is compared and contrasted to UK law and Indian law on mergers to determine the best and worst aspects. Consequently, one may extract the best qualities from each law and come up with an ideal law on mergers. Such comparison also sheds light on the practicality of mergers in the real world when observing factors of success and failure by providing examples of companies in Malta, UK and India. These recommendations may be taken to fill in gaps and improve Maltese law. |
