| Abstract: | Picture a situation in which you find yourself deeply frustrated by an action undertaken by the government or a public authority. However, it's important to note that this particular action does not meet the criteria for an administrative act, as previously defined in our discussions. Specifically, it does not encompass any issuance of orders, licenses, permits, warrants, decisions, or refusals to any demands made by a claimant. To quote Chapter 490, it also doesn't involve authorization and concession. Furthermore, this situation doesn't fall under the category of a legislative act because it doesn't entail the promulgation of subsidiary legislation. It also does not encompass an action or inaction marked by negligence, imprudence, or a disregard for the duty prescribed by law, and as a result, you appear to have incurred damages, at least on the surface. |
