| Abstract: | This dissertation conducts a comparative analysis of the rights to private life of European Union (EU) nationals and Third-Country Nationals(TCN) migrants, focusing on family-related legislation and practices. It explores the definition of family, reunification procedures, and challenges faced by TCN migrants regarding expulsion and rejection of family reunification applications. Examining legislation and ECtHR judgments, it elucidates the legal frameworks shaping family definitions for both groups. Procedural aspects of family reunification are dissected, revealing the disparities between EU and TCN nationals. Pressing issues such as expulsion threats and challenges in family reunification application rejections are addressed, highlighting systemic barriers and discriminatory practices. By advocating for legal reform and policy intervention, this dissertation contributes to migration and human rights discourse, emphasizing the need to protect fundamental rights regardless of nationality. |
