The new cannabis legislation : a legal analysis

Abstract

In the wake of the effective legalisation of cannabis and the establishment of the first operational cannabis associations in Malta earlier this year, this dissertation ventures into some of the intricacies of the law while scrutinising the repercussions stemming from the legislative gaps inherent in cannabis legalisation frameworks. Despite the honourable reasons behind such legalisation, notably the fight against the black market, the current state of affairs has resulted in several uncertainties. Cannabis was always prevalent in Malta, however, acquiring cannabis for recreational purposes has become easier, by simply registering as a member of a licensed cannabis association. Understandably, the legalisation of cannabis is not isolated from broader implications. Hence, this thesis explores the repercussions of cannabis use in everyday activities that any individual may engage or be engaged in. Throughout this thesis, it becomes evident that extensive studies are required to be carried out by the state to pave the way for the successful implementation of Malta's harm reduction approach, both in terms of enforcing current provisions and the operation of cannabis associations. In light of the above, within these gaps lies the potential for positive change and the refining of legislation. Thus, this study aims to emphasise the importance of addressing any legislative shortcomings relating to cannabis use.
