Abstract: The work represents an analysis of data protection in Malta and the role of the Data Protection Commissioner. It considers whether the Commissioner's office is sufficiently endowed with legal competence and resources to be able to offer effective data protection to data subjects and to fulfill the responsibilities assigned to him by law. It highlights the office's lack of resources and the lack of transparency arising from limited accessibility of the public to the Commissioner's decisions and reports. The research identifies good practices in regulation through the drafting of guidelines in consultation with relevant stakeholders. This legal thematic study served as background research for the comparative report on Data protection in the European Union: the role of National Data Protection Authorities by the Fundamental Rights Agency and carried out under the network FRALEX.
