| Abstract: | This contribution does not purport to exhaustively address all categories of errors of law which have led courts to annul planning permissions on points of law following the endorsement of such permissions by the Environment and Planning Review Tribunal (EPRT). Its scope is intentionally limited to one specific form of legal error: that which arises from a flawed invocation or application of planning policy, resulting in a seemingly valid outcome that is, in truth, legally defective. |
