| Abstract: | The legalisation of prostitution remains a highly polarised issue. In Malta, while the act of prostitution itself is not illegal, related activities such as pimping and brothel-keeping remain criminal offences. Evidence from various countries indicates that the full legalisation of prostitution has not reduced harm for individuals caught up in the trade. Instead, it has intensified the commodification of vulnerable populations—particularly women and girls—and contributed to an increase in human trafficking. Drawing on this evidence, the paper argues that Malta should adopt the Equality Model. This approach criminalises the purchase of sex while providing comprehensive support and exit strategies for those in prostitution. Implemented in several countries, the model has demonstrated positive outcomes, including reductions in trafficking and improved support for individuals wishing to leave prostitution. It promotes gender equality and offers a rights-based framework that prioritises protection over profit. |
