Abstract: This study looks into Malta’s compliance with the Common European Asylum System (CEAS) by first outlining the CEAS, its present ramifications, and future alterations, and then using that knowledge in relation to the Maltese situation. With respect to the principle of mutual trust, it was thought out to observe Malta’s compliance with the umbrella legislation of this field by viewing its confirmed cases of non-compliance. Therefore, the research methodology of this study featured the analysis of asylum case law where Maltese authorities were found to have committed human rights violations against irregular immigrants who went through the Maltese asylum regime. By comprehending the CEAS as a whole, outlining background information of the Maltese context (demographic and political), and analysing this case law, this study was able to conclude that the Maltese asylum regime is indicative of some systemic deficiencies.
