Abstract: This thesis proposes to be a detailed study of the position obtaining in Malta with regard to the various rules regulating the letting of agricultural or rustic tenements. It is not only the existing; legislation as such which will be scrutinized. Previous rules which have eventually been superceded, will be referred to, as well as the origin of the same parts of the law itself, and where relevant9 even comparisons with foreign law will be made. It is being made clear from the very beginning that the rules governing Agricultural leases in these Island are not to be found all conveniently listed, one after the other, in some chapter of the Civil Code, as someone not sufficiently acquainted with the subject might hope. But (and this indeed has been the fate of a large number of legal institutes which, since the latest edition of the Laws of Malta, have had to undergo substantial changes, in order to meet with the ever-increasing social and economic demands of the country and its inhabitants), the codified rules have been supplemented by subsequent legislation, which in its turn, is also continously being subjected to amendment, as the necessity for changes in the law arises.
