Abstract: The purpose of chapter one gives a historical outline leading to the coming into force of the 1991 Agreement. The second chapter deals with various aspects of Agreement mainly the general and moral issues involved. The second part of this chapter examines the status of the 1991 Agreement as an International Treaty. The third chapter discusses the Financial Aspect of the Agreement with reference to Articles 5 to 7 of the Agreement and in Section 6 of the 1992 Act. The fourth chapter deals with the Mortmain Act. It gives a historical outline, discusses the 1967 Act and its amendment by Act IV of 1992. Chapter five gives a historical outline of the development of Land Registration in Malta and discusses changes brought about through Act IV of 1992 and the 1995 amendments. Chapter six examines the effect of the Agreement with regards to third parties. Chapter seven deals with the Memorandum of Understanding 2000 signed by both parties to the Agreement. The conclusion deals with the 'problems' caused by the 1992 Act particularly with regards to third parties, and possible remedies are suggested.
