Abstract: Proving paternity has always been thought a problem. The "juris et de jure" presumption is "pater is est quern justae nuptiae demonstrant", meaning that a child conceived in wedlock is held to be the child of the mother's husband; but this presumption can be rebutted in certain specific cases. Our law admits proof against paternity only in four instances by means of an action of disavowal or "denegata paternita". In tackling this short dissertation, I intend to compare and contrast the relevant sections of our law dealing with the action of disavowal with Italian, French and German Law, whilst keeping in mind the proposed amendments in the recent White Paper on family law in Malta. I also intend to emphasise the issue of the importance of the use of Blood Group Tests and DNA Tests.
