| Abstract: | The object of this dissertation is that of examining how canon 1095 subsections (2) and (3) of the Code of Canon Law have been interpreted by doctrine and jurisprudence as well as making some observations on the various views that have been propounded on this very delicate and difficult part of the Code. Prior to going into the details of the two subsections, it is in may view important to put this canon in its right perspective. This canon was introduced as it is in the new code in 1983. It is "formalmente nuovo, anche se in realta' non e' altro che il risultato degli apporti che sul punto sono stati forniti dalla giuris prudenza, quella rotale innanzi tutto". Canon 1095 must be read and understood within the wider and encompassing concept of marriage itself. Here one observes that the outlook towards marriage that emerges from the 1917 Code is different from that emanating from Vatican Council II: "Nel codice del 1917 il matrimonio come realtà naturale era spiegato a partire dalla categoria del contratto (can. 1012) stipulato dai due sposi mediante il consenso (can. 1081(1)). Per quanto il consenso fosse considerato costitutivo del matrimonio, in una visione molto riduttiva, veniva spiegato come un semplice atto di volonta' con dai due sposi davano e ricevevano il diritto perpetuo ed esclusivo sul corpo in ordine agli atti idonei alla generazione dalla prole (can. 1081 (2)). In una tale concezione L'amore coniugale non trovava alcuna rilevanza nel momenta costitutivo del matrimonio (matrimonium in fieri) secondo l'adagio della giurisprudenza canonica: consensus non amor facit nuptias" [...]. |
