Sustainability has become an increasingly prominent concept in competition law. As an example, the Revised Guidelines for Horizontal Cooperation Agreements, now include a dedicated chapter on sustainability agreements. The Guidelines clarify which sustainability agreements would fall foul of competition rules and those which do not. In general terms, where horizontal and vertical sustainability agreements do not negatively affect the parameters of competition, they will not be capable of raising competition law concerns. The study unit CML 3006 Competition law refers to agreements which would be justified under (3) of Article 101 where they would contain a sustainability purpose, such as the reduction in pollution, where such agreements do not restrict competition.

Sustainability is ingrained in the various aspects of environmental justice. Indeed, the course looks into concepts such as the common good, human rights, climate change, gender issues, the marine environment, litigation and regulation which all in one way or another are linked with sustainability. The course also looks into legislation related with sustainability issues.

This study unit looks into environmental law principles such as the use of natural resources as a common good, the legal implications of sustainable development, responsibility for environmental harm, the polluters pays principle and the precautionary and preventive principles.

The course also provides an overview of the EU Framework for Action on Cultural Heritage which incorporates sustainability as one of its pillars to regerenate cities and regions, promote adaptaive re-use of heritage buildings and balance access to cultural heritage with sustanable cultural tourism and natural heritage.

This study-unit relates to the international regulation of anthropogenic activities (not involving the exploitation of living resources) that lead to pollution and degradation of the oceans. It would address the applicable international regimes regulating: shipping, dumping, extraction of mineral resources, the transboundary movement of wastes and hazardous substances marine pollution from land based sources and unsustainable exploitation of the coast.
