DESCRIPTION Rationale & Learning Objectives:

The aim of this study-unit is to provide a possibility to students interested in Civil Law to study the subject in greater detail. In this way those who wish to extend further their knowledge of law and to obtain a wider perspective of Civil Law than that which they would already have achieved during the first year of their course, as part of the Elements of Maltese Law, are given the opportunity to do so. The course also provides a background to the private/Civil Law aspect which accountants, working in a commercial environment, encounter.

Indicative Syllabus & Study-unit Outline:

The study-unit begins with basics and fundamental such as the Law of Property and the various categories and distinctions relative to property and ownership, co-ownership and usufruct. Particular focus is placed on the law of obligations: this commences with a review of the law of contract: the requirements for the formation and validity of contracts, the effects and implications of contract. The Law of damages is then examined, both as to damages flowing from contract and also as to damages in tort.

Attention is given to the Law of sale and commercial sale, including questions related to delivery and obligations of the buyer and the seller.

Finally, the study-unit examines aspects of security and guarantees.
