TITLE Criminal Procedure 2: Of Matters Applicable to All Criminal Trials

DESCRIPTION This study-unit studies criminal procedure, namely articles 629 to 698 of the Criminal Code. These deal with the law of evidence, prescription and court fees. The law of evidence is in turn divided into: confessions; documentary evidence; evidence obtained through experts and through witnesses. Students will be taught the laws and case law relevant to the subject of this study-unit.

Study-unit Aims:

The aim of this study-unit is to enable the student to understand the rules regulating evidence, prescription and court fees in the courts of criminal jurisdiction. In so far as evidence is concerned, this is subdivided into four parts: (a) witnesses; (b) confessions; (c) expert evidence; and (d) documentary evidence. These provisions are found in articles 629 to 698 of the Criminal Code.

Learning Outcomes:

1. Knowledge & Understanding:
By the end of the study-unit the student will be able to:

(a) understand the general rules of the law of evidence in criminal procedure as distinct from those in civil procedure;
(b) know what are the rules of evidence;
(c) comprehend the rules which apply to prescription of a criminal offence;
(d) know which fees have to be paid in connection with judicial proceedings before a court of criminal jurisdiction.

2. Skills:
By the end of the study-unit the student will be able to:

(a) identify the rules regulating the four types of evidence regulated by the Criminal Code;
(b) comment upon on the rules regulating prescription in criminal procedure;
(c) interpret the salient case law on the law of evidence;
(e) write on court fees.
