DESCRIPTION By far, Tribunal activity is taken up by processes for the declaration of marriage nullity. It is therefore imperative that students following this Masters course are provided with a good foundation of the Church’s pastoral solicitude for those persons who have to face a failed, and possibly null, marriage. This study-unit therefore concentrates on different particular issues related with the process for a declaration of nullity: the interested parties, the respective roles and responsibilities of the Tribunal’s officials and assisting Lawyers, as well as the various means provided by canon law to assist the Tribunal to find the truth and do justice to all concerned. Furthermore this study unit provides for a deeper understanding of selected issues which have proved to be of particular importance in the procedural sphere.

Study-unit Aims:

This study-unit presents a number of special issues of particular and sometimes problematic interest with relation to the matrimonial process, both in the First Grade as well as in the Appellate stage.

Learning Outcomes:

1. Knowledge & Understanding:
By the end of the study-unit the student will be able to:

-- possess a deeper understanding of the Church’s pastoral solicitude for couples faced with a failed marriage;

-- better understand the true nature and dynamics of the matrimonial contentious process;

-- appreciate the respective roles and responsibilities of the various persons involved in Tribunal procedures.

2. Skills (including transferable [generic] skills):
By the end of the study-unit the student will be able to:

-- develop an ethical attitude;

-- offer judicial assistance to parties in a marriage case;

-- gather, assess and interpret evidence.
